TERMS & CONDITIONS OF SERVICE
1. ARRIVAL
  • Provide the necessary details needed for Registration of the student either through online method or in the Registration Forms provided.
  • Swimmers are advised to arrive 15 minutes earlier for every lesson to avoid delays. Lesson time lost due to delays will not be made up.
  • NO STUDENT CARD, NO LESSON POLICY. A replacement student card will be issued on payment of a fee of RM20.
  • Mark attendance using the card scanning facility provided or any other method of attendance marking as provided or carried out by the DSA Management.

2. PAYMENT & LESSON FEES
  • Payment of lesson fees for the FOLLOWING MONTH will be done on the 3rd week of the CURRENT MONTH.
  • In the event of non-payment by the 4th week of the current month, the swimmer may not be allowed to attend his/her first lesson of the followng month and there is no guarantee that the assigned lesson slot will still be available, unless due to special circum stances, and with the prior written approval from the DSA Management.
  • The fees is NOT transferable and is valid until lesson completion for D SWIM ACADEMY SDN BHD (DSA) programs and activities only.
  • All lessons must be completed within the validity period. Lessons will NOT be carried over to the following month.

3. CANCELLATION / REPLACEMENT / MAKE-UP OF LESSONS
  • DSA lessons schedules are fixed and no compensations, replacemements or make-up lessons will be provided for absentism, late-coming or cancellations of any sort for any reason by the student.
  • Replacement/Make-up lessons due to illness, school programs will be considered but not guaranteed upon presentation of valid medical certificates or supporting school letters. Replacement/Make-up lessons will be granted at the sole discretion fo the management and no reason needs to be given for any refusal to replacement/make-up lessons.
  • Replacement/Make-up lessons are granted based on the availability of slots. In the event that no slots are available, the lessons can be forfeited and no refunds will be given.
  • Replacement/Make-up lessons for cancellations of classes for any reason by the Management will be made but it is not guaranteed that it will be with the existing swim teacher.

4. REFUNDS OR PRO-RATED FEES
  • No refunds and no pro-rated lesson fees of any sort will be possible.
  • Refund on unused lessons or replacement lessons will be considered but not guaranted in the circumstances that a swimmer is hospitalised, with duly presented medical certificates as required. Refunds on unused lessons or replacement lessons are granted at the sole discretion of the Management and no reason will be given for any refusal of refund.

5. CHANGE IN PERSONAL CONTACT INFORMATION
  • Swimmers/Parents/Guardians have to fill in and return a GENERAL FORM for changes to swimmer/parent/guardian personal contact details.

6. REQUEST FOR CHANGE OF LESSON TIME
  • Swimmers/Parents/Guardians have to give in a completed GENERAL FORM if he/she wishes to request for a change in the lesson time.
  • Only upon written confirmation by the management of DSA shall the new requested lesson time be confirmed. Prior to that, if no written confirmation has been given to the swimmer/parent/guardian, the original lesson time will run as per normally scheduled.

7. TEMPORARILY DEFERRING/SUSPENSION OF LESSON
  • Swimmers are only allowed to temporarily suspend their lesson for a minimum and a maximum period of 1 month.
  • Swimmers/Parents/Guardians have to fill in and return a GENERAL FORM for temporarily deferring/suspension of lessons.
  • The full returning/resuming month’s fee will have to be paid in advance upon the request to temporarily defer/suspend of the lesson.
  • In the event of non-payment, there is no guarantee that the slot will continue to be reserved for the swimmer and no appeals will be entertained.
  • DSA, without any prior notice has the absolute discretion to withdraw a student who has been absent for three (3) continuous classes.

8. CLASS ARRANGEMENT
  • Students must stay out of the pool prior to and after lessons. We want everyone to be safe and have fun! Please watch all siblings as well.
  • Pool Rules and Regulations must be observed and obeyed at all times.
  • All students are to attend lessons according to the schedule and time table which has been fixed for them.
  • All students are required to be punctual for lessons as there is strictly no replacement time/lessonsfor late arrivals.
  • There will be no lessons on the 5th week of each month, which fall under the same day/days of the class, unless prior arrangement made by the management. The 5th week of each month will include weekdays and weekends.

9. DISTURBANCE / RIGHT OF REFUSAL
  • Parents and Guardians are not allowed to create or cause any disturbance during any on-going lessons.
    With the exception of the DSA Lil' Swimmers class, anyone accompanying students must remain away from the pool. Family and friends can view lessons from the designated area.
  • DSA Management reserves the right to require a swimmer/parent/guardian to leave if he/she is causing a disturbance, annoying other parents/guardians/swimmer or DSA staff or is behaving in an unacceptable manner.
  • We reserve the right to accept only those families who abide by our child-centred philosophy; to remove from our program/lessons those families that do not abide by the philosophy; fail to follow rules, use foul language, or are disrespectful to teachers, administrator, staff or fellow swimmers.
  • DSA Management reserves the right to refuse a swimmer/parent/guardian entry and lesson if, on arrival, management reasonably considers that the swimmer/parent/guardian is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.
  • The Management will be under no responsibility to renew or extend lessons beyond the original period, nevertheless, any such renewal or extension shall be on the conditions that the swimmer/parent/guardian complies with all rules, regulations & conditions. The lesson is given at the sole discretion of the Management and no reason will be contributed for any refusal.

10. TERMINATION OF LESSONS
  • Any member who misuses the facilities, does not comply with all the rules and procedures in effect at DSA or who acts in a way which constitutes a safety hazard or interferes with the enjoyment of other swimmers/parents/guardian/DSA Staff will have his or her lessons terminated with immediate effect. In addition the Management reserves the right to terminate the lessons of any swimmers/parents/guardian at any time, without notice, and at its sole discretion. In the event of a lesson being terminated under this regulation, any refund will also be at the sole discretion of the Management.

11. GENERAL RULES & LIABILITY
  • No Smoking anywhere on the premises.
  • Secure your valuables. D SWIM ACADEMY SDN BHD (DSA) & Management of the venue shall not be liable for any loss.
  • The Company and the DSA Management of the venue shall not be liable for untoward incidents on the premises.

It is the responsibility of swimmer/parent/guardian to read all announcements.

13. ASSESSMENT & PROGRESS ADVISOR
  • A progress advisor is available at all sessions to answer any questions you may have regarding the program, or your children’s progress. Please do not hesitate to speak with them at any time on pool deck.

14. PHOTOGRAPHIC / VIDEO / AUDIO / COMMUNICATION RELEASE
  • By signing this document you hereby authorise D Swim Academy Sdn Bhd to take and use any photographs, video or sound recordings of you/your child and reproductions or adaptations of your/his/her likeness (“the material”), either in full or part, in conjunction with any wording or drawings, in any D Swim Academy Sdn Bhd publication, production and presentation, including electronic/internet marketing materials for the purpose of promoting D Swim Academy and its programmes in a positive manner. You understand that the materials will and could still be used even after you/your child has discontinued D Swim Academy Sdn Bhd services unless the individual revokes consent by writing to the Management of D Swim Academy Sdn Bhd. If you do not agree, please advise D Swim Academy Sdn Bhd in writing.
